These Terms of Service (these “Terms”) explain the relationship between fortheworld OÜ (“fortheworld”, “we” or “us”) and you when you (i) access and use our websites, including forthe.world, sustainable.deals, sustainable.day, sustainable.page, sustainable.report, sustainability.day, and sustainable.support (together, the “Sites”) and/or (ii) use or purchase our proprietary applications, online sessions, consulting, and any other services offered through the Sites (the “Services”).
These Terms govern visitors’ access to and use of the public areas of the Sites, as well as registered users' access to and use of the Services. For the purposes of these Terms, “you” or “your” refers to you as a visitor or as a registered user of the Services.
1. License Grant
The Services are owned by fortheworld and are licensed, not sold, to you. Subject to your compliance with these Terms and payment of all applicable fees, fortheworld grants you a personal, non-exclusive, non-transferable, limited license (without the right to sublicense) to access and use the Sites and Services.
All rights not expressly granted herein are reserved by fortheworld.
2. Your Use of the Services
A. Registration
Unless you are visiting only the public areas of the Sites, you are required to register and create an account to use the Services (“Account”). You agree that you will maintain and update your registration and account information to ensure it is current, complete, and accurate. We have the right to suspend or terminate your Account if you provide untrue or incomplete information.
B. Your Responsibilities
You are responsible for providing the equipment and services (e.g., internet connection) that you need to access and use the Services.
You are responsible for all activities that occur through your Account, whether or not authorized by you. Please do not share your Account credentials with any other person.
You will use the Services only for your personal or internal business purposes and in accordance with all applicable laws, rules, and regulations.
You agree that you will not use the Services for unlawful purposes or to engage in any illegal, offensive, or objectionable conduct, including the violation of any third-party privacy rights.
Except as specifically permitted in these Terms or expressly authorized by us in writing, you will not directly or indirectly: (a) distribute, sell, rent, lease, or sublicense the Services; (b) reproduce, adapt, create derivative works of, or otherwise modify the Services; or (c) permit any third party to engage in any of these acts.
C. Prohibited Actions
You are not permitted to: (a) remove or alter any copyright or other proprietary rights notices contained in the Services; (b) decompile, reverse engineer, or otherwise attempt to discover the source code of the Services; or (c) circumvent any functionality that controls access to or otherwise protects the Services.
3. Our Responsibilities
fortheworld OÜ is responsible for providing the Services in accordance with these Terms and applicable laws.
We will maintain commercially reasonable administrative, physical, and technical safeguards intended to protect the security and confidentiality of the information you provide to us.
We reserve the right, but are not obligated, to improve, enhance, or modify the Services.
fortheworld OÜ is not responsible for the content of third-party services or for any claims arising from your use of third-party websites, software, or services with which you may interact when you use our Services (“Other Services”).
4. Availability
We use commercially reasonable efforts to make the Services available to you 24 hours per day, 7 days per week, excluding scheduled maintenance, unavailability caused by you or any hardware/software not provided by us, emergency maintenance, and/or any cause beyond our reasonable control (including natural disasters, civil disturbances, strikes, or internet service provider failures).
5. Your Content
The Services may allow you to upload, transmit, and use information and other content (collectively, “Your Content”). You are solely responsible for the accuracy, quality, and legality of Your Content. You grant fortheworld a worldwide license to use, reproduce, transmit, and display Your Content as necessary for us to provide the Services to you in accordance with these Terms.
Without limiting the terms of our Privacy Policy, you understand that:
We do not guarantee that your use of the Services and/or Your Content will be private or secure.
We may analyze Your Content to derive insights (“Analytical Data”). fortheworld may use and distribute such Analytical Data for product development and improvement, provided that such data is in an aggregated, de-identified (anonymized) form that would not permit a third party to identify you. fortheworld retains all intellectual property rights in such Analytical Data.
6. Fees and Payment
You agree to pay fortheworld for the Services at the then-current rates as displayed at the time of purchase or booking. We reserve the right to change our fees upon thirty (30) days' advance notice to you.
Payment Processing: fortheworld does not store, process, or transmit your credit card data but relies on trusted third-party payment processors (e.g., Stripe) to handle these functions. You must comply with such third party’s terms.
Subscriptions & Cancellation: Payments are due in accordance with the fee schedule, often annually or monthly in advance. To cancel a recurring Service, please visit your account settings or contact us. Cancellations will take effect at the end of the current paid term, and no refunds will be provided for partial periods.
Late Payments: If any amount owed is not received by its due date, such amounts may bear interest at the rate of 0.05% per day or the maximum rate permitted by applicable law, whichever is less.
7. Warranties
THE SERVICES ARE LICENSED "AS-IS," "WITH ALL FAULTS," AND "AS AVAILABLE." YOU BEAR ALL RISK OF USING THEM. fortheworld GIVES NO EXPRESS WARRANTIES, GUARANTEES, OR CONDITIONS. To the extent permitted under your local laws, fortheworld excludes any implied warranties or conditions, including those of merchantability, fitness for a particular purpose, and non-infringement. fortheworld does not warrant that the Services will meet your requirements or that their operation will be uninterrupted or error-free.
8. Limitation of Liability
IN NO EVENT WILL fortheworld BE LIABLE TO YOU OR ANY THIRD PARTY FOR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF USE, DATA, OR PROFITS OR BUSINESS INTERRUPTION).
fortheworld's LIABILITY WITH RESPECT TO ANY SINGLE INCIDENT ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE RELEVANT SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE INCIDENT. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU HEREUNDER.
9. Ownership and Intellectual Property
The Services, including their "look and feel" (e.g., text, graphics, images, logos) and all related intellectual property, are and will remain the property of fortheworld. You agree not to take any action inconsistent with such ownership interests.
Any suggestions for correction, changes, or other feedback you provide to us (collectively, “Feedback”), and any improvements or modifications relating to the Services (“Revisions”), are and will remain the property of fortheworld. You hereby assign to fortheworld any and all right, title, and interest you may have in and to any and all Feedback and Revisions.
10. Indemnification
You agree to indemnify and defend fortheworld and its affiliates, directors, and employees from and against all claims, losses, and expenses (including reasonable attorneys' fees) brought against us by any third party arising from your use of the Services or any violation of these Terms, the rights of a third party, or applicable law.
11. Modification and Termination
Modification: We may modify these Terms at any time. Modifications become effective upon your first access to or use of the Services after the "Last Updated" date at the top of this page.
Termination: These Terms will automatically terminate if you fail to comply with any term or condition herein. Upon termination, you will cease all use of the Services. Sections that by their nature are intended to survive (including, but not limited to, Sections 8, 9, 10, and 12) will survive any termination.
12. Governing Law and General Terms
Governing Law: These Terms are governed by the laws of the Republic of Estonia, without regard to its conflict of law principles.
Dispute Resolution: You agree to first contact us at support@sustainable.support to resolve any dispute informally. If a dispute is not resolved, it shall be brought exclusively in the courts of Tallinn, Estonia.
Entire Agreement: These Terms, together with our Privacy Policy and any applicable order forms, constitute the entire agreement between you and fortheworld regarding the Services.
Remedies: You agree that a breach of these Terms will cause injury to fortheworld for which money damages will not be an adequate remedy, and fortheworld will be entitled to seek equitable relief in addition to any other remedies.
